These terms and conditions apply to your access to the Systema Sport Ltd. website
("Our Website"). Please read these terms and conditions carefully before accessing
and/or ordering any goods from our website. If you access the Systema Sport Ltd.
website, and/or place an order for goods, you agree to be bound by these terms and
conditions. If you do not agree with the terms and conditions please do not use our
website.

How to order goods on Our Website
|
|
By placing an order through our website, you warrant that you are legally capable of entering into binding contracts.
|
|
To Order through Our Website
|
- Select the goods you require and click ‘Buy Now’;
- Choose the quantity of goods you wish to purchase. Please note that a limit is set to nine
(9) units per item. To order quantities greater than 9 units per item, please contact
Customer Services
who will be able to assist you with your order;
- Review your basket making sure all specifications such as size and colour fit your
requirements, then click the "Check out with PayPal" button;
- If you are a new user you will need to create a PayPal account, by entering an email address
and password. You must keep your password confidential as they allow access to your account. To
continue setting up an account you will need to enter your personal details, billing address
(which must correspond with your payment card address) and delivery address;
- Once you have set up a PayPal account, you will be directed to the shipping confirmation page
where you may select the type of delivery, and vary delivery and/or billing addresses. Any
voucher codes can be entered on the shipping confirmation page;
- You will then proceed to the secure payment page where you may select the payment type
and complete your order. Following submission of your order we will send you an automated
order acknowledgement to the email address provided.

How the contract is formed between you and us
|
|
After placing your order you will receive an automated acknowledgement. Please note that this
does not mean that your order has been accepted. All orders are subject to acceptance by us,
and we will confirm acceptance to you by confirming that your order has been dispatched. Once
we accept your order, a contract to purchase and supply goods takes effect.

|
|
The contract to supply goods to you only relates to those goods whose dispatch we have confirmed
in the confirmation email. We will not be obliged to supply any other goods which may have been
part of your order until the dispatch of your goods has been confirmed in a separate dispatch
confirmation email.

You will be charged when we receive your order.
|

Prices for goods on our website appear on the Buy Now page and include all UK taxes.
Prices and offers may vary and may only be available for limited periods. All prices and offers
are subject to availability and may be withdrawn or amended at our discretion. The prices on our
website may differ to prices in stores, catalogues or elsewhere.

Our website contains a number of goods and it is possible that, despite our best efforts, some
of the goods listed on our website may be incorrectly priced. If we discover an error in the
price of the goods you have ordered we will inform you as soon as possible. We will give you
the option of reconfirming your order at the correct price or cancelling it.

|
We are under no obligation to provide incorrectly priced goods to you at the incorrect price
if the pricing error is obvious and unmistakeable and could have reasonably been recognised
by you as an error.

The goods will be at your risk from the time of delivery. Ownership of the goods will pass to
you when we receive full payment, including delivery charges.

Data protection and privacy

Any personal information you provide to us and from which you can be identified is stored securely
and confidentially and is processed fairly and lawfully in accordance with this privacy policy.

We take appropriate technical and organisational measures to protect against unauthorised or unlawful
processing of your personal information, including encrypting your information to applicable industry
standards.

During your visit to our site we may gather certain personal information that is necessary to set up
your account, for the purposes of billing, delivery of your goods and queries. We only keep your
information for as long as is necessary to process your order, process any applicable refunds,
respond to any complaints/feedback, or to provide you with promotional information you have subscribed
to.

Ordinarily we do not have access to your financial information which is securely transferred directly
to our card processing agents and who process it on our instructions.
|
|
|
We supply your information electronically to our couriers who need your details to deliver your orders.
|
|
|
Our card processing agents and couriers are required to maintain the security and confidentially of
your personal details, and are required not to retain, share, store or divulge any personal
information for any other purposes.

When you register your details with us, you have the option to subscribe to future promotions and
special offers. You may unsubscribe from this at any time by emailing
Customer Services.

We do not transfer your information outside the European Economic Area (“EEA”) unless you are a user
located outside the EEA in which case we may need to transfer your information to deliver your goods,
process payment/refunds, or to send you promotional information you have subscribed to.

Our website can recognise past users by using cookies. Cookies personalise your visits to our website
to meet your individual preferences. You can disable cookies by adjusting your internet settings.

When you supply your information to us you accept the risks associated with the Internet and will not
hold us responsible for any loss of your information unless we have breached our duty of care to you.

Method of Payment
|
|
You may pay by VISA, Master Card, Switch, Maestro, Electron, or JCB. Please ensure you provide
the cardholder's name as it is shown on the card, and the billing address corresponds as it appears
on the card statement. Payment will be taken in GB pounds (£), and if applicable, your card will be
charged according to the exchange rate at that time.

Fraud Prevention
|
|
To help us prevent fraud, orders of £200 GB pounds or more may require a landline telephone number.
Card fraud is illegal and perpetrators will be reported to the police.
|
|
|
Delivery
|
|
Delivery costs are additional to the displayed price and vary depending on the delivery service
you select, the country of delivery and the quantity/weight of goods ordered. We will confirm the
total price payable, including delivery charges, when we accept your order.
|
|
|
Orders that exceed 30 kg in weight may be subject extra delivery charges. If any order is subject
to extra delivery charges we will contact you to advise you before it is dispatched. You have the
option to cancel the order if you do not wish to pay any additional delivery costs.
|
|
|
UK Delivery
|
|
UK orders for delivery to a UK address will have the delivery costs confirmed at the time of
ordering. We use UK Post Office Mail but reserve the right to change this to alternative
suppliers at our sole discretion.
|
|
|
Delivery times depend on the delivery service selected by us and the types of goods ordered.
We always aim to dispatch all goods in stock as quickly as possible. The maximum UK delivery
lead time for goods is 30 days unless specifically agreed with you. Once payment is cleared we
aim to dispatch within 3 working days.
|
|
|
For special deliveries we will quote you for a Courier Delivery. Couriers will require a
signature to ensure safe receipt of your goods. If you are not available to collect and sign on
the courier’s first visit, a calling card will be left with the courier’s contact number to
rrange re-delivery. Our courier’s will deliver until 9pm in most areas.
|
|
|
The couriers will attempt re-delivery up to a maximum of three (3) times and if delivery is
not successful after the third attempt they will return the goods to us and we will contact
you to arrange re-delivery. We reserve the right to re-charge the delivery cost for re-delivery.
|
|
|
UK Delivery option: 24 hr delivery
|
|
If you select our 24 hr delivery option, which is only available by calling us, and your UK
order is placed and accepted before 2pm Monday to Thursday, we aim to have your order delivered
to your door the very next day, provided the next day is not a UK bank or public holiday. If you
place an order after 2pm on a Thursday, or on a Friday, Saturday or Sunday then we aim to have
the goods delivered the following Tuesday.

|
If your order is over five (5) units we will endeavour to ship the whole order as requested,
however larger orders may be delivered in separate parcels (see "Split Delivery"). This may result
in a delay in the dispatch of your order. When dispatched, your order will be sent on a next day
delivery service.
|
|
|
24 hr delivery is not available for certain areas of the UK including the Highlands and the Channel
Islands. For a full list of available postcodes please contact
Customer Services.
If the delivery
destination is located in an area where 24hr delivery is not available, your order will be delivered
as soon as possible.
|
|
|
UK Delivery option: Standard delivery
|
|
If you do not request the 24 hr delivery option you will receive your goods via standard delivery.
We aim to have all accepted UK orders placed before 2pm dispatched within three (3) working days,
although this time may be extended if your order is placed close to a UK bank or public holiday.
|
|
|
Overseas/International delivery, including the Highlands, Channel Islands and Republic of Ireland
|
|
Delivery time to overseas/international destinations will vary depending on where the delivery
destination is. In the event that your order has not arrived within a reasonable period of time
please contact
Customer Services.
|
|
|
Please note that our 24 hr delivery service is not available for delivery to overseas/international
destinations.
|
|
|
Overseas/International delivery - Import duty
|
|
If you order goods from our site for delivery outside the UK, they may be subject to import duties
and taxes which will be levied when the order reaches the delivery address. You will be responsible
for payment of any such import duties and taxes. We have no control over these charges and cannot
predict their amount. For further information please contact your local customs office before
placing your order.

|
If you order large quantities of goods for delivery overseas/internationally, we reserve the right
to contact you and inform you of any additional shipping costs at which time you may either pay the
extra amount or cancel your order.
|
|
|
Any orders being delivered outside of the UK may be subject to additional duty charges. These
charges relate specifically to the destination country and in all cases must be paid by the
customer and not Systema Sport Ltd. If there are additional charges you will be informed by the
courier local to your region at time of delivery.
|
|
|
Please also note that you must comply with all applicable laws and regulations of the country for
which the goods are destined. We will not be liable for any breach by you of any such laws.
|
|
|
Delivery of pre-order items
|
|
If you pre-order goods with a launch date, then we will reserve your goods and hold the order
until the day before the launch date.
|
|
|
Delivery of Personalised Goods
|
|
Personalised goods are non refundable, (please note that this does not affect your statutory
rights). Our 24 hr delivery service is only available within the UK and cannot be guaranteed
on orders that include personalisation due to the extended processing time. If your order is
a mix of personalised and non personalised goods then the personalised goods will be sent
separately at no additional cost to you, please see "split delivery".

Split delivery
|
|
We may split delivery of your order into several parts based on stock availability. You will
not be charged extra for this facility.
|
|
|
Free delivery offers
|
|
Free delivery offers only apply to UK Mainland orders and are not available for certain areas
of the UK, including the Highlands and the Channel Islands. Free delivery offers are sent using
Standard delivery service, please see "UK Delivery option: Standard delivery". Free delivery
offers cannot be used in conjunction with any other offer, promotion or discount code.

Our Returns Policy
|
|
You may cancel your order any time within seven (7) working days, beginning on the day after
you received the goods. We will refund the price of the goods in full, however you will be
responsible for the cost of postage for delivery and for returning the goods to us. If a refund
is payable to you we will process the refund as soon as possible, and, in any case within thirty
(30) days of the day you give written notice of cancellation.

|
To cancel an order, you must inform us in writing. You must also return the goods to us immediately,
in the same condition in which you received them, and at your own cost and risk.
|
|
|
You have a legal obligation to take reasonable care of the goods while they are in your possession.
If you fail to comply with this obligation, we may have a right of action against you for
compensation. This applies to all goods that are returned.
|
|
|
Our returns policy does not affect your statutory rights.
|
|
|
If you return goods claiming they are defective, we will examine the returned goods and will
notify you of your refund via e-mail within a reasonable period of time. We will process the
refund due to you as soon as possible and, in any case within thirty (30) days of the day we
confirm via e-mail that you are entitled to a refund for defective goods.
|
|
|
If a refund is payable to you, we will usually refund the money using the same method originally
used by you to pay for your purchase but this is at our discretion.
|
|
|
Any orders for personalised goods are non-refundable. Please note that this does not affect your
statutory rights.

Warranty and limitation of our liability
|
|
We warrant to you that any goods purchased from us through our website will be of satisfactory
quality, comply with descriptions on our website and be reasonably fit for all the purposes for
which goods of the kind are commonly supplied.

Our contractual or tort (including negligence) liability for losses you suffer as a result of us
breaking this agreement is strictly limited to the purchase price of the goods.
|
|
This does not include or limit in any way our liability:
- For death or personal injury caused by our negligence;
- For fraud or fraudulent misrepresentation; or
- For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

We are not responsible for any indirect or consequential losses whether caused by tort (including
negligence), breach of contract or otherwise. By purchasing goods through our website you agree
that we are not responsible for any indirect or consequential losses. This clause does not affect
your statutory rights.

We make no warranty that this website is free from computer viruses or any other malicious or
impairing computer program.
|
|
|
The information contained in our website may be updated from time to time and may be out of date.
We accept no responsibility for keeping the information on our website up to date, or liability for
not doing so.

Events outside our control
|
We will not be liable or responsible for any failure to perform, or delay in performance of any
of our obligations to you that is caused by events outside our reasonable control (a ‘Force
Majeure Event’). A Force Majeure Event includes any act, event, non-happening, omission or accident
beyond our reasonable control and includes (without limitation) the following:
- Strikes, lock-outs or other industrial action;
- Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether
declared or not) or threat or preparation for war;
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
- Impossibility of the use of railways, shipping, aircraft, motor transport or other means of
public or private transport;
- Impossibility of the use of public or private telecommunications networks; or
- The acts, decrees, legislation, regulations, or restrictions of any government.
In the event of a Force Majeure Event, our performance is deemed to be suspended for the period
that the Force Majeure Event continues, and we will have an extension of time for performance for
the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event
to a close or to find a solution by which our obligations to you may be performed despite the Force
Majeure Event.

|

Applicable laws require that some of the information or communications we send to you should be
in writing. By accessing our site you accept that communication with us will be primarily electronic
through e-mail or notices posted on our website. For contractual purposes, by accessing this website
you agree to this electronic means of communication and you acknowledge that all contracts, notices,
information and other communications that we provide to you electronically comply with any legal
requirement that such communications be in writing. This condition does not affect your statutory
rights.

this website, are owned or licensed to Systema Sport Ltd., or are used with permission from the

We take all feedback very seriously and aim to deal with complaints as quickly and effectively
as possible.

To assist us in dealing with your complaint, please detail all aspects of the complaint, your order
number and your contact details.

We aim to conclude our investigations as soon as possible after receiving the initial complaint.
A likely timescale for resolution will be provided upon request, but this timescale will be dependant
upon the specific nature of the complaint.

Our right to vary these terms and conditions
|
We reserve the right to revise and amend these terms and conditions from time to time. You will
be subject to the terms and conditions that are in force at the time that you order goods from
us unless:-
- any change to these terms and conditions is required to be made by law or governmental authority,
in which case the changes may apply to orders previously placed by you; or
- we notify you of any changes to these terms and conditions before we accept your order, in which
case we have the right to assume that you have accepted the change to the terms and conditions
unless you notify us to the contrary within seven (7) working days of receipt by you of the goods.

Safety Warning
|
|
Physical activities can be hazardous. The selection and use of suitable equipment requires skill,
and you should ensure you are appropriately equipped and trained. In the interests of your safety
and the safety of others, you should also ensure that you are properly trained in the techniques
you will need to employ in pursuit of your chosen activity. We recommend that you seek and take
the advice of a suitably qualified person before purchasing your equipment. Once purchased, the
equipment should only be used in accordance with the manufacturers’ instructions and should
likewise be inspected before use and properly maintained. Nothing in this notice affects your
statutory rights.

WEEE Regulations
|
|
The Waste Electrical and Electronic Equipment (WEEE) Directive is now U K law. The legislation
aims to make producers pay for the collection, treatment and recovery of waste electrical equipment.
The regulations also mean that suppliers of equipment like internet retailers must allow consumers
to return their waste equipment free of charge, although you would be responsible for postage.

The amount of WEEE we throw away is increasing by around 5% each year, making it the fastest
growing waste stream in the UK.
|
|
|
Much of the UK’s WEEE ends up in landfill, where the lead and other toxins it contains can cause
soil and water contamination. This can have a harmful effect on natural habitat, wildlife and
also human health.
|
|
|
Many electrical items that we throw away can be repaired or recycled. Recycling items helps to
save our natural finite resources and also reduces the environmental and health risks associated
with sending electrical goods to landfill.
|
|
|
Goods are marked with the crossed out wheeled bin symbol to show that they were produced after
13th August 2005, and should be disposed of separately from normal household waste so that they
can be recycled.
|
|
|
Distributors of new Electric and Electronic Equipment (EEE) have a part to play in reducing the
amount of WEEE going into landfill sites.
|
|
|
Systema Sport Ltd. are obliged under these regulations to offer our customers free take-back of
their WEEE on a like-for-like basis when you buy from us a new Electrical or Electronic product.
|
|
|
For example, if a customer bought a new electrical item from us we would accept their old electric
item and prevent it going into a landfill site by disposing of it safely. Customers must return
their WEEE item to us within 28 days of purchasing their new item at their own expense.
|
|
|
Jurisdiction
|
|
The Courts of England and Wales shall have exclusive jurisdiction over all claims or disputes
arising in relation to, out of or in connection with this website including orders for goods.
By accessing this website you agree to submit to English law.
